Abstract

The basis of faith in civil law is the rule contained in an agreement, whether it is between individuals with individuals or individuals with legal bodies; standard contracts remove the basis of freedom of contracting. Standard contracts that do not provide a balance of interests for the parties lead to a reaction that leads to the need to give a "decent" place to the basis of faith in the formulation and implementation of the agreement. This requirement is based on article 1338 (3) of the Code, which states that "agreements shall be executed in good faith." Good-hearted people put their full trust in the people they believe to be honest. They don't hide anything bad that can cause trouble in later days. Each contract must undergo a credibility test both during the pre-manufacturing, manufacture (signature), and post-manipulation phases. (pelaksanaan).
